Traffic Violations

Routine traffic stops by police in New York often lead to serious criminal charges and messy legal situations for those behind the wheel and their passengers.

A recent traffic stop posed just such an outcome for three New York residents who were found to be in possession of drugs after their car was stopped by police. The driver and both passengers were all alleged to be in possession of various illegal drugs, and all were charged with criminal possession of a controlled substance with intent to sell, as well as other charges.

This case is noteworthy because it demonstrates the seriousness which all police in the state of New York show when dealing with drug related crimes. It furthermore illustrates that even when stopped for routine traffic violations, any and all suspected crimes or infractions on the part of drivers or passengers will be investigated fully. In some cases, police overstep legal boundaries in such investigations.

It is important to remember that all those charged are innocent until proven guilty in a court of law. Furthermore, the anticipated trial of these three people could very likely raise questions about the legality of the search executed by police, and whether the defendants’ rights were fully respected during the stop.

If you are facing drug charges that resulted from a traffic stop, it is possible that legal boundaries were crossed when police searched your vehicle and arrested you. If you suspect that this may be the situation, then you may want to speak with an attorney regarding what your legal rights are and how best to protect them.
