A New York man previously arrested on drug charges following a traffic stop was arrested again recently for alleged sale and possession of heroin. According to police, the warrant was issued for two counts of sale of a controlled substance and two more counts of criminal possession of a controlled substance, following an investigation alleging that the man had sold and possessed heroin.

He was further charged with criminal possession of a weapon and stolen property, as well as with privately selling or disposing of a gun.  These additional charges came while he was already in jail for an arrest stemming from a traffic stop. In his previous arrest he was charged with drug possession of heroin and marijuana and driving while ability impaired. He also received a speeding ticket.

Drug charges may seem difficult to defend against. However, all individuals are granted certain rights under the law, and it is always important to understand your options. Defending against drug charges stemming from a traffic stop can often involve scrutinizing the police procedure during the stop itself.

For instance, was there probable cause for the stop? Did police perform a search and seizure without a search warrant? Were the driver’s rights violated during the stop?
