Driving on the wrong side of the road is rarely a good idea. One New York motorist discovered that it is an even worse idea to do so when intoxicated.

The 30-year-old motorist was observed by police as he was driving on the wrong side of the road. When they pulled him over, the officers realized that he was intoxicated. This was important because, according to the police, the motorist refused to cooperate with them when he was asked to take a breath test to measure his blood alcohol content level.

Because the police had seen his erratic driving behavior of being on the wrong side of the road and noted other signs of intoxication when they pulled him over, officers were able to arrest him on a DUI charge even without the BAC level that the breath test would have given them to support their observations.

It appears that the driver might have gotten away with only a misdemeanor DUI charge were it not for a prior conviction. Once found out that he had a previous conviction on drunk driving charges within the past 10 years, police made the decision to increase the severity of the charge against him by elevating it from a misdemeanor to felony drunk driving.
